TERMS OF SERVICE AND USER AGREEMENT

1. ACCEPTANCE OF TERMS

By accessing, browsing, downloading, installing, logging into, or otherwise using the website, services, software, code, scripts, or content provided by the KillSecurly Foundation (collectively, the "Service"), you explicitly acknowledge that you have read, understood, and agree to be bound by the terms and conditions set forth in this Agreement. If you do not agree to these terms, or if you do not possess the legal capacity to agree to these terms, you must immediately cease all use of the Service and remove any related data from your devices. Your continued use of the Service constitutes an irrevocable acceptance of this Agreement and any future modifications hereto.

2. ELIGIBILITY AND AGE RESTRICTIONS

2.1. Minimum Age Requirement. Access to and use of the Service is strictly limited to individuals who are at least thirteen (13) years of age. By accessing or using the Service, you represent, warrant, and affirm that you are thirteen (13) years of age or older.

2.2. Prohibition on Users Under 13. If you are under the age of thirteen (13), you are expressly prohibited from registering for, accessing, or using the Service in any capacity. The Foundation does not knowingly collect, retain, or process information from children under the age of thirteen (13). Any account found to be operated by a user under the age of thirteen (13) will be terminated immediately and without notice.

3. PROHIBITED USERS: EDUCATIONAL INSTITUTION STAFF

3.1. Exclusion of Educational Staff. The Service is strictly prohibited for use, access, inspection, or auditing by any individual employed by, contracting with, or acting as an agent for any educational institution, school district, board of education, university, college, or similar academic entity ("Educational Personnel").

3.2. Definition of Educational Personnel. "Educational Personnel" includes, but is not limited to: teachers, professors, instructors, teaching assistants, school administrators, principals, superintendents, information technology (IT) staff, network administrators, system administrators, security vendors, third-party contractors, lunch staff, custodial staff, and any other employee or agent acting on behalf of an educational institution.

3.3. Unauthorized Access. Any access by Educational Personnel constitutes unauthorized access and a breach of this Agreement. Educational Personnel are strictly forbidden from creating accounts, accessing the Service to monitor student activity, reverse-engineering the Service, or utilizing the Service for any investigative or administrative purpose.

4. LICENSE GRANT AND PERSONAL USE RESTRICTIONS

4.1. Limited License. Subject to your full compliance with this Agreement, the Foundation grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service.

4.2. Personal Use Only. The Service is provided solely for your personal, private, and non-commercial use. You agree that you will not use the Service for any commercial purpose, business operation, or revenue-generating activity.

4.3. Prohibition on Commercialization. You may not sell, resell, lease, rent, license, sublicense, distribute, or otherwise exploit the Service or any part thereof for any commercial gain. Any use of the Service outside of personal, private usage is a material breach of this Agreement.

5. ACCOUNT SECURITY AND NON-SHARING COVENANT

5.1. Non-Transferability of Account. Your account is personal to you. You may not sell, gift, trade, transfer, assign, or bequeath your account, username, or access rights to any third party.

5.2. Prohibition on Account Sharing. Sharing of accounts is strictly prohibited. You agree that you will not permit any other individual to access the Service using your credentials. You are solely responsible for maintaining the confidentiality of your login information.

5.3. Liability for Unauthorized Access. You are fully responsible and liable for all activities that occur under your account, whether or not such activities were authorized by you. If the Foundation detects simultaneous access from different locations or evidence of account sharing, the Foundation reserves the right to immediately suspend or terminate the account without recourse.

6. PROHIBITION ON DISTRIBUTION OF EXPLOITS

6.1. No Distribution. You expressly agree that you will not distribute, disseminate, post, upload, transmit, publish, or otherwise make available to any third party any exploits, vulnerabilities, bypass methods, source code snippets, or hacking tools ("Exploits") related to, derived from, or targeting the Service or associated third-party services.

6.2. Confidentiality of Vulnerabilities. Any vulnerabilities, bugs, or security flaws discovered within the Service must be kept confidential and may not be shared publicly or privately with other users, forums, repositories (such as GitHub), or social media platforms.

6.3. Zero Tolerance. The Foundation maintains a zero-tolerance policy regarding the distribution of Exploits. Any evidence of such distribution will result in an immediate, permanent ban from the Service and potential legal action to the fullest extent permitted by law.

7. TERMINATION

7.1. Right to Terminate. The Foundation reserves the absolute right, in its sole discretion, to terminate, suspend, or restrict your access to the Service at any time, for any reason, or for no reason, with or without notice.

7.2. Effect of Termination. Upon termination of your account or access rights, your license to use the Service shall immediately cease. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. THE FOUNDATION EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE FOUNDATION MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE KILLSECURLY FOUNDATION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
